10 Secrets To Winning Your Auto Accident Case

 

 

 

1. Call a Personal Injury Attorney- Calling an attorney quickly after your accident can help you tremendously, if you wait too long your statute of limitations may run out and you won't be allowed to file a claim.  Personal injury attorneys are experienced in working with accident victims.  They can give you a lot of advice concerning your potential case and can help you get the necessary documents you need for insurance companies.

 

2. Gather Information and Evidence- Take pictures of the accident scene and any injuries or scars that arise from the accident.  If you can, gather information from any withnesses including their phone numbers.  Don't assume that the police took down everyone's information just because they spoke to them.  Get license plate numbers of all other vehicles involved in the accident.

 

3. Get Immediate Medical Treatment- Make sure to tell your treating doctors about any and ALL complaints.  "Don't be stoic" If you describe how you're feeling from head to toe it allows your doctor to treat ALL of your injuries, not just the major ones.  This also helps your attorneys with documentation.

 

4. Keep Your Attorneys Informed- It is important that your attorneys know about any changes going on in your life since your accident.  This includes things such as moving or getting a divorce.  It's also very important that you keep us updated on your medical status.  Don't assume that your doctors are going to tell your attorneys what's going on.

 

5. Be Careful Who You Talk To- It's best if you don't discuss your case with anyone other than your doctors and your attorneys.  Don't talk to insurance reps after the crash either on the phone or in person.  Beware that they may also have you under surveillance, if the insurance company catches you trying to exert yourself just ONE TIME, they will assume that you are back to doing your normal activities at 100%.  Don't jeapordize your case and recovery by trying to do things before you are truly physically able (i.e. trying to ride again or resuming any recreational activities).

 

6. Make Copies Of EVERYTHING- You never know what might be useful so any documents relating to your accident (i.e. medical bills, photos, health insurance cards) should be copied for you and your attorney.  Make a note of any money you have spent for prescriptions, any time you missed work, etc.

 

7. Report Your Accident To The Authorities- It's always best if your local police can come to the scene of your accident to make a report and take witness statements.  If the police were not at the scene, make sure you file a report at your local police station.  Records of the report become public documents and can help with the validity of your case later on.

 

8. Be Honest With Your Attorney and Doctors- If you had previous accidents or injuries, your doctors and attorney need to know about them.  Most of your past medical history is going to be scrutinized by the insurance company so it is important that your providers are aware of your ENTIRE history.  It's also important that you are honest about anything in connection with your wage loss claim.  Any exaggeration about your wage loss or work history can hurt your credibility.  If there is an issue regarding your tax returns (used to document past income) you should advise your attorney of it immediately.

 

9.
